Inventory process
The inventory process is designed to enable the division of assets among the different heirs.
This takes place whenever any of the following situations occurs:
- There is no agreement among the interested parties to the inheritance;
- The Public Prosecutor requires such a process in defence of an heir without any legal capacity;
- Some heirs are unable to intervene — due to their absence or unknown locations or de facto permanent incapacities.
The inventory process may be requested by any of the parties with an interest in the inheritance.
The inventory request may be submitted through filling out an online form (www.inventários.pt) or through a physical support in keeping with its delivered to a competent notary office.
In case of inventory processes due to death, the competent notary office is that located in the municipality where the succession is opened, which corresponds to last place of residence of the deceased person.
In case of inventory processes due to divorce or similar, this competence generally belongs to the notary office located in the municipality hosting the family residence.
These inventory processes may also serve for the annulment of shared assets by the spouses following separation, divorce or declaration of the nullity or annulment of the marriage.
